Where permitted based on a visitor’s age, jurisdiction, and privacy choices, our analytics providers also collect personal information from you when you access or use our products and services. They may receive categories of personal information such as identifiers and device information, geolocation data, usage data, and inferences based on and associated with that data, as described in the Cookies and Similar Tracking Technologies section of this Statement. Some of these providers may combine this data across multiple sites for their own purposes and those of others. For example, on certain areas of our site, we use Google Analytics on our website to help us understand how users interact with our website; you can learn how Google collects and uses information at www.google.com/policies/privacy/partners.
Some of the data disclosures to these providers may be considered a “sale” or “sharing” of personal information as defined under the laws of California and other U.S. states. Please see the “Privacy Choices” and “California Privacy Rights” sections below for more details.
Please note that some of our products and services also include integrations, references, or links to services provided by other parties whose privacy practices differ from ours. If you provide personal information to any of those third parties, or allow us to disclose personal information with them, your personal information is governed by their privacy statements.
4. Aggregate and De-identified Data
We may also use and disclose aggregated and de-identified data. Where we use, disclose, or process aggregated and de-identified data, we will maintain and use the information in de-identified form and will not attempt to reidentify the information, except as permitted by applicable privacy laws.
5. Cookies and Similar Tracking Technologies
We and our providers may use cookies, pixels (also known as clear GIFs, web beacons or tags) and other tracking technologies to automatically collect information, such as browsing, activity, device and similar information, within our Sites and Services.
We may use tracking technology information to, for example, analyze and understand how users access, use and interact within our Sites and Services, to identify and resolve bugs and errors, and to assess secure, protect, optimize and improve performance. We use a neutral age-screening mechanism before enabling non-essential tracking technologies. For users identified as under 18, non-essential cookies and tracking technologies are disabled. For information about the choices you have regarding the use of cookies on our Sites, review Section 9. Privacy Choices.
Cookies. Cookies are small text files placed by a website and stored by your browser on your device. Some cookies allow us to make it easier for you to navigate our Site and Services, while others are used to allow us to track your activities on our Sites and Services. For more information on how to manage your privacy choices with respect to Cookies and similar technologies, please review the options provided in the Privacy Choices section below. Visitors to our Sites and Services who disable cookies will be able to browse certain areas of the Site, but some features may not function. For a list of cookies used on this Site, see the Cookie Settings.
Pixels. Pixels are tiny graphics with a unique identifier, similar in function to cookies that are embedded invisibly on webpages and electronic communications. We may use these in connection with our Sites and Services to, among other things, track the activities of Site visitors, help us manage content, and compile statistics about usage. We and our service providers may also use pixels in HTML e-mails, to help us track e-mail response rates, identify when our e-mails are viewed, and track whether our e-mails are forwarded.
Analytics. We use automated devices and applications that are provided by third parties, such as Google Analytics, to evaluate usage of our Sites and Services. We use these tools to help us improve the performance of our Sites and Services and user experiences. These entities may use cookies and other tracking technologies as part of their services. For more information about Google Analytics and how to opt out of collection of your browsing data by Google Analytics, you can download the Google Analytics Opt-out Browser Add-on to prevent your data from being used by Google Analytics at https://tools.google.com/dlpage/gaoptout.
6. Third Party Links
Our Site and Services may contain links to unaffiliated websites. Any access to and use of such linked websites is not governed by this Statement but instead is governed by the privacy policies of those websites. We are not responsible for the information practices of such websites.
7. Security
We have implemented safeguards that are intended to protect the personal information we collect from loss, misuse, and unauthorized access, disclosure, alteration, and destruction. Please be aware that despite our efforts, no data security measures can guarantee security.
8. Retention
We retain the personal information we collect only as reasonably necessary for the purposes described above or otherwise disclosed to you at the time of collection, including for as long as necessary to comply with our tax, accounting and recordkeeping obligations, administer applicable returns and warranty programs, and for research, development and safety purposes, as well as an additional period of time as necessary to protect, defend or establish our rights, defend against potential claims, and comply with legal obligations.
9. Privacy Choices
You have certain choices regarding our processing of your personal information. For example:
Cookie Preferences.
- Cookie Controls. You can manage your preferences by adjusting your cookie settings within the browser, or you can use our cookie preference manager provided by Cookiebot. These preferences are browser-specific.
- Global Privacy Control. Some browsers and browser extensions support the “Global Privacy Control” (GPC) or similar controls that can send a signal to the websites you visit indicating your choice to opt-out from certain types of data processing, including data sales and/or targeted advertising, as specified by applicable law. When we detect such a signal, we will make reasonable efforts to respect your choices indicated by a GPC setting or similar control that is recognized by regulation or otherwise widely acknowledged as a valid opt-out preference signal.
- Do Not Track. Some browsers include a "Do Not Track" (DNT) setting that can send a signal to the websites you visit indicating you do not wish to be tracked. There is not a common understanding of how to interpret the DNT signal; therefore, our websites do not respond to browser DNT signals.
These choices are specific to the device or browser you are using. If you access our Sites and Services from other devices or browsers, please ensure to take these actions from those devices or browsers to ensure your choices apply to the data collected when you use them.
Email Web Beacons. Most email clients have settings that allow you to prevent the automatic downloading of images, including web beacons, and the automatic connection to the web servers that host those images.
Targeted Advertising and Data Sales. Some privacy laws define “sale” broadly to include some of the disclosures described in the “Disclosures of Personal Information” section above. To opt out of targeted advertising, sales, or otherwise control such disclosures, you have several options. First, you can use the controls available through our website cookie banner to decline analytics-related cookies. Second, you can use the Global Privacy Control setting in a web browser or browser extension as described above. Third, you can use the other cookie controls described above.
These choices are specific to the device or browser you are using. If you access our services from other devices or browsers, take these actions from those devices or browsers to ensure your choices apply to the data collected when you use them.
Access, Deletion, Portability, and Correction. You may email us at privacy@drseuss.com if you would like to request to review or modify personal information that you have submitted to us.
Additional Rights. Depending on where you reside, you may have additional rights under applicable privacy laws (including Virginia, Colorado, Connecticut, etc.), subject to certain limitations. California residents can view their rights in Section 13 below. UK, EU, and Swiss residents can view their rights in Section 14 below.
These rights may include:
- Correction: to request that we correct inaccuracies in your personal information, taking into account the nature and purposes of the processing of the personal information.
- Deletion: to request that we delete your personal information provided to or obtained by us.
- Access: to confirm whether we are processing your personal information and to obtain a copy of your personal information in a portable and, to the extent technically feasible, readily usable format.
- Opt-Out: to opt out of certain types of processing, including:
- To opt out of the “sale” of your personal information.
- To opt out of targeted advertising by us.
- To opt out of profiling or automated decision-making that produce legal or similarly significant effects.
To exercise your rights under applicable law, you may submit a request by email to privacy@dr.seuss.com. We may decline requests in certain cases. For example, we may decline requests where granting the request would be prohibited by law, could adversely affect the privacy or other rights of another person, would reveal a trade secret or other confidential information, or would interfere with a legal or business obligation that requires retention or use of the data. Further, where permitted by law, we may decline a request where we are unable to authenticate you as the person to whom the data relates or verify your agent has authorization to submit the request on your behalf, the request is unreasonable or excessive, or where otherwise permitted by applicable law. If you receive a response from us informing you that we have declined your request, in whole or in part, you may submit a request to appeal by email to privacy@drseuss.com.
10. Changes to this Statement
This Statement is current as of the Effective Date set forth above. We may change this Statement from time to time, so please be sure to check back periodically. We will post any changes to this Statement on our Sites and Services. If we make material changes to the Statement, we will provide notice or obtain consent regarding such changes as may be required by law.
11. Contact Us
If you have questions about the privacy aspects of our Sites or Services or would like to make a complaint, please contact us at privacy@drseuss.com.
12. Children’s Privacy Notice
We offer Sites and Services that are intended for users of all ages. However, some portions of our Sites and Services are intended to be accessed and used primarily by children. The information in this section applies only to the personal information that we collect online from children who access and use our Sites and Services that are directed to children or from children as defined in their country of residence (hereafter, each a “child” and collectively, “children”). The operator of our Sites and Services is Dr. Seuss Enterprises, L.P., 9668 Scranton Road, Suite 1100, San Diego, CA 92121; 858-888-7896.
We collect limited persistent identifiers to support the internal operations of our Sites and Services. Specifically, we may use them to:
- maintain or analyze the functioning of the Sites and Services;
- perform network communications;
- protect the security or integrity of users or the Sites and Services; and
- ensure legal or regulatory compliance.
We maintain policies and practices designed to limit the use and disclosure of persistent identifiers to these operational purposes and to prevent their use for other purposes not permitted by applicable law, including securely storing the data and limiting its access to only personnel needed to support our internal operations.
Retention Statement. We retain persistent identifiers collected from children only for as long as reasonably necessary to support the specific internal operations described above. Our business need for retaining this information is to maintain and operate the Sites and Services, perform necessary network communications, maintain the security and integrity of the Sites and Services, and comply with applicable legal requirements. We delete the information after 12 months and do not retain children's personal information indefinitely or for purposes other than those disclosed in this Statement.
13. Additional Information for California Residents
In this section, we provide additional information to California residents about how we handle their personal information, as required under California privacy laws, including the California Consumer Privacy Act (“CCPA”). This section does not address or apply to our handling of publicly available information or other personal information that is exempt under the CCPA, such as personal information subject to COPPA.
CCPA Privacy Rights. Under the CCPA, California residents have the following rights (subject to certain limitations) with respect to the personal information we collect and maintain about them:
- Right to Notice. At or before the time of collection, you have a right to receive notice of our practices, including the categories of personal information and sensitive personal information to be collected, the purposes for which such information is collected or used, whether such information is sold or shared, and how long such information is retained. You can find those details in this Statement by clicking on the above links.
- Right to know: You have a right to request that we disclose to you the personal information we have collected about you. You also have a right to request additional information about our collection, use, disclosure, or sale of such personal information. Note that we have provided much of this information in this Statement.
- Correction and Deletion: You also have rights to request that we correct inaccurate personal information and that we delete personal information under certain circumstances, subject to several exceptions.
- Opt out of “sales” and “sharing for cross context behavioral advertising”: You have a right to opt-out from future “sales” or “sharing” of personal information as those terms are defined by the CCPA. Note that the CCPA defines “sell,” “share,” and “personal information” very broadly, and some of our data disclosures described in this privacy statement may be considered a “sale” or “sharing” under those definitions. In particular, we let analytics providers collect identifiers (IP addresses, cookie IDs), activity data (browsing, clicks), device data, and geolocation data through our Sites and when you use our online Services, but do not “sell” or “share” any other types of personal information. If you do not wish for us or our partners to “sell” or “share” personal information relating to your visits to our sites for advertising purposes, you can make your request by managing your cookie and tracking technology preferences, using a Global Privacy Control, or using other controls described in the “Privacy Choices” section of this statement. If you opt-out using these choices, we will not disclose or make available such personal information in ways that are considered a “sale” or “sharing” under the CCPA. However, we will continue to make available to our partners (acting as our service providers) some personal information to help us perform advertising-related functions. Further, using these choices will not opt you out of the use of previously “sold” or “shared” personal information or stop all interest-based advertising. We do not knowingly sell or share the personal information of minors under 16 years of age.
- Limit use and disclosure of sensitive personal information: You have a right to limit our use and disclosure of sensitive personal information for any purpose other than to provide the Sites and Services you request or as otherwise permitted by law. We do not use sensitive personal information beyond these authorized purposes.
- Non-discrimination: You have a right not to be subject to discriminatory treatment for exercising your rights under the CCPA.
To exercise your rights in accordance with this section, you can contact us via the contact details described above in Section 11. Contact Us.
To provide, correct, or delete specific pieces of personal information we will need to verify your identity to the degree of certainty required by law. When you submit a CCPA request to us, we will take steps to verify your request by matching the information provided by you with the information we have in our records.
In some cases, we may request additional information to verify your request or where necessary to process your request. If we are unable to adequately verify a request, we will notify the requestor.
You may designate an agent to make requests on your behalf. Authorized agents may initiate a request on behalf of another individual by contacting us via email as described above in Section 11. Contact Us. Before accepting such a request from an agent, we will require the agent to provide proof you have authorized it to act on your behalf, and we may need you to verify your identity directly with us.
Shine the Light. Additionally, under California Civil Code section 1798.83, also known as the “Shine the Light” law, California residents who have provided personal information to a business with which the individual has established a business relationship for personal, family, or household purposes (“California Customers”) may request information about whether the business has disclosed personal information to any third parties for the third parties’ direct marketing purposes. Please be aware that we do not disclose personal information to any third parties for their direct marketing purposes as defined by this law. If you have further questions, you can contact us as described in Section 11. Contact Us (above).
14. European, UK, and Swiss Data Protection Rights, Legal Bases, and Processing Locations
Data Protection Rights. If the processing of personal information about you is subject to European Union, UK, or Swiss data protection law, you have certain rights with respect to that information:
- You can request access to, and rectification or erasure of, personal information;
- If any automated processing of personal data is based on your consent or a contract with you, you have a right to transfer or receive a copy of the personal information in a usable and portable format;
- If the processing of personal information is based on your consent, you can withdraw consent for future processing at any time;
- You can object to, or obtain a restriction of, the processing of personal information under certain circumstances; and
- For residents of France, you can send us specific instructions regarding the use of your personal information after your death.
To make such requests, please contact us as described in Section 11. Contact Us. You also have the right to lodge a complaint with a supervisory authority, but we encourage you to first contact us with any questions or concerns.
Legal Bases for Processing. We rely on different lawful bases for collecting and processing personal information about you, for example, with your consent and/or as necessary to provide the services you use, operate our business, meet our contractual and legal obligations, protect the security of our systems and our customers, or fulfil other legitimate interests.
Location of Processing European Personal Data. We transfer personal information from the European Economic Area (EEA), United Kingdom (UK), and Switzerland to other countries, some of which have not been determined by the European Commission to have an adequate level of data protection. When we do so, we use legal mechanisms, including contracts, to help ensure your rights and protections.
